ACCOUNT TERMS & CONDITIONS
3D Models 2 the Max

These Account Terms & Conditions (“Terms”) govern the creation and use of customer accounts on the 3D Models 2 the Max website (“Site”) and the purchase, download, and use of digital products offered through the Site.
By creating an account, purchasing a digital product, or otherwise using account-related features of the Site, you agree to these Terms, our Privacy Policy, applicable Digital Product License, Refund Policy, and any other policies posted on the Site.
If you do not agree to these Terms, you should not create an account or purchase products through the Site.
1. CUSTOMER ACCOUNTS
You may create a customer account to purchase digital products, access eligible previous purchases, participate in MAX Rewards, and use other customer features offered through the Site.
You agree to provide accurate and current information when creating and maintaining your account.
Your account is personal to you and may not be sold, transferred, shared, or assigned to another person without our permission.
You are responsible for maintaining the confidentiality of your account credentials and password.
You are responsible for activity conducted through your account unless the activity resulted from circumstances reasonably outside your control.
If you believe someone has gained unauthorized access to your account, you should contact us immediately.
We reserve the right to suspend, restrict, or terminate accounts that violate these Terms, our licensing requirements, or other Site policies.
2. AGE REQUIREMENTS
You must be at least 18 years old, or the age of legal majority where you live, to independently create an account and enter into purchases through the Site.
If you are under the applicable age of majority, purchases must be made by or with the involvement and authorization of a parent or legal guardian.
3. DIGITAL PRODUCTS
3D Models 2 the Max sells digital products only unless a product listing specifically states otherwise.
Products may include:
- >STL files
- >3D model files
- >ZIP archives
- >Digital head sculpts
- >Digital accessories
- >Busts
- >Printable models
- >Bundled digital files
- >Other downloadable 3D-design content
No physical product will be shipped when purchasing a product identified as a digital download.
Customers are responsible for reviewing the complete product description, images, file formats, scale information, compatibility information, and license terms before purchasing.
4. PURCHASING DIGITAL PRODUCTS
When you purchase a digital product, you are purchasing a license to use the digital file under the applicable license terms.
Purchasing a digital product does not transfer ownership of the underlying digital design, intellectual property, website content, or associated rights to you.
Payment is due at the time of purchase.
Once payment has been successfully processed, the applicable digital download will normally become available through the delivery method provided by the Site.
Customers should download and securely back up purchased files.
We do not guarantee that every product will remain available for download indefinitely.
5. DIGITAL PRODUCT LICENSE
Unless a product listing or separate license expressly states otherwise, digital products sold by 3D Models 2 the Max are licensed for personal use only.
Under a standard personal-use license, you may:
- >Download the purchased files.
- >Store reasonable backup copies for your own use.
- >Resize or prepare the files for your own compatible 3D printer.
- >Print the model for your own personal collection.
- >Paint or customize your personally printed copy.
Unless expressly authorized by a separate commercial license, you may not:
- >Resell the digital files.
- >Share the files with another person.
- >Give copies of the files to friends, groups, or other customers.
- >Upload the files to file-sharing websites, cloud-sharing services, forums, social media groups, torrents, marketplaces, or other distribution platforms.
- >Redistribute the files for free.
- >Sell modified versions of the digital files.
- >Claim the digital files as your own work.
- >Convert the files into another format for the purpose of redistribution.
- >Include the files in another digital product, bundle, collection, or archive for redistribution.
- >Use purchased files to create digital products for resale.
- >Use the files commercially unless a commercial-use license has been expressly granted.
Purchasing a file does not grant permission to redistribute the digital file.
Additional licensing conditions may appear on individual product listings and will apply to those products.
6. COMMERCIAL LICENSES
Certain products may offer an optional commercial-use license.
If a commercial license is available, the specific permissions and restrictions will be described separately.
Purchasing a standard digital product does not automatically provide commercial rights.
Commercial licenses, when offered, may contain restrictions concerning quantities, physical prints, redistribution, modification, manufacturing, or other commercial activities.
7. REFUNDS AND DIGITAL DOWNLOADS
Because our products are digital files that may be immediately accessed or downloaded, all digital product sales are generally final once the file has been made available for download, except where a refund is required by applicable law.
Refunds will generally not be provided because:
- >You changed your mind.
- >You purchased the wrong model.
- >You purchased a file accidentally.
- >You did not read the product description.
- >You do not have a compatible 3D printer.
- >You do not have compatible slicing or modeling software.
- >You do not know how to prepare, support, slice, print, scale, or modify the file.
- >Your printer produced an unsuccessful print.
- >You expected a physical product instead of the clearly identified digital download.
- >You no longer want the product after downloading it.
If a purchased file is corrupted, incomplete, or materially different from the file described in the listing, contact us so we can investigate the issue and, when appropriate, provide a corrected or replacement file.
Nothing in this section limits rights that cannot legally be waived under applicable consumer-protection law.
8. PRICING ERRORS
We attempt to provide accurate product descriptions and pricing.
However, typographical errors, technical errors, incorrect pricing, or other mistakes may occasionally occur.
If a product is listed at an obviously incorrect price or material information is incorrect, we reserve the right to cancel the affected transaction.
If payment has already been collected and we cancel the transaction, the applicable payment will be refunded through the original payment method where reasonably possible.
9. MAX REWARDS
Registered customers may be eligible to participate in our MAX Rewards loyalty program.
Under the current standard program:
Points are earned on eligible purchases based on the amount actually paid after eligible discounts and rewards, subject to the rules displayed on the Site.
MAX Points:
- >Have no cash value.
- >Cannot be exchanged for cash.
- >Cannot be sold.
- >Cannot be transferred between customer accounts unless expressly permitted by us.
- >May not be awarded on taxes, refunds, canceled transactions, or other excluded amounts.
- >May be removed when a qualifying purchase is refunded, canceled, reversed, charged back, or determined to be fraudulent.
- >May be subject to additional promotional or redemption restrictions displayed on the Site.
Rewards cannot reduce an eligible merchandise subtotal below zero.
We may offer promotional opportunities to earn additional MAX Points, including bonus-point promotions.
We reserve the right to correct point balances resulting from technical errors, duplicate transactions, refunds, fraud, abuse, or other account errors.
We may modify, suspend, or discontinue MAX Rewards in accordance with applicable law. Material changes will be communicated through the Site or other reasonable means when appropriate.
Abuse, manipulation, exploitation, or fraudulent use of MAX Rewards may result in forfeiture of points and suspension or termination of the associated customer account.
10. CHARGEBACKS AND PAYMENT DISPUTES
If you believe there is a problem with a purchase, we encourage you to contact us first so we can attempt to resolve the issue.
Fraudulent or abusive payment disputes and chargebacks are prohibited.
If a payment is reversed, charged back, or otherwise canceled, access to the associated digital product may be suspended or terminated where legally permitted.
MAX Points earned from the transaction may also be removed.
We reserve the right to suspend an account while a payment dispute involving that account is being investigated.
Nothing in this section prevents customers from exercising legitimate rights available through their payment provider or applicable law.
11. PROHIBITED CONDUCT
You may not use the Site to:
- >Engage in illegal or fraudulent activity.
- >Attempt to gain unauthorized access to another customer’s account.
- >Attempt to gain unauthorized access to our systems, databases, servers, or administrative areas.
- >Interfere with the normal operation or security of the Site.
- >Introduce malware, viruses, malicious scripts, automated attacks, or harmful code.
- >Scrape, harvest, copy, or systematically collect Site information using unauthorized automated methods.
- >Circumvent download limitations, security measures, licensing controls, or account restrictions.
- >Manipulate MAX Points or other promotional systems.
- >Create fraudulent purchases or payment disputes.
- >Use stolen payment information.
- >Share account credentials for the purpose of giving others access to purchased digital files.
- >Redistribute purchased digital products.
- >Violate our intellectual property rights or the rights of others.
We reserve the right to investigate suspected violations.
12. INTELLECTUAL PROPERTY
Except where otherwise stated, the Site’s original content, branding, graphics, logos, product presentations, website design, text, and digital products are owned by or licensed to 3D Models 2 the Max and are protected by applicable intellectual property laws.
Purchasing a digital product grants only the applicable license described with the product.
It does not transfer copyright or ownership of the underlying digital product or other intellectual property.
The 3D Models 2 the Max name, branding, logos, and original website materials may not be copied, reproduced, or used commercially without authorization.
13. INTELLECTUAL PROPERTY COMPLAINTS
3D Models 2 the Max respects intellectual property rights.
If you believe content appearing on our Site infringes intellectual property rights that you own or are authorized to represent, please contact us with sufficient information for us to evaluate the claim.
Your notice should include, as applicable:
- >Your name and contact information.
- >Identification of the copyrighted or protected work.
- >Identification and location of the material you believe is infringing.
- >A description of your rights in the work.
- >A statement explaining why you believe the use is unauthorized.
- >A statement that the information provided is accurate.
- >Confirmation that you are the rights holder or are authorized to act on behalf of the rights holder.
- >Your physical or electronic signature where required.
We may remove or restrict access to material while reviewing a legitimate intellectual property complaint.
14. AVAILABILITY OF THE WEBSITE
We aim to keep the Site available and operational but cannot guarantee uninterrupted availability.
The Site may occasionally be unavailable because of:
- >Maintenance.
- >Updates.
- >Server issues.
- >Internet outages.
- >Payment-provider interruptions.
- >Security incidents.
- >Third-party service failures.
- >Technical problems.
- >Circumstances outside our reasonable control.
We may modify, suspend, discontinue, or replace Site features when reasonably necessary.
15. PRODUCT AVAILABILITY
Digital products may be updated, modified, replaced, or removed from the Site at any time.
The fact that a customer previously purchased a product does not guarantee that the product will remain listed or hosted indefinitely.
Customers are strongly encouraged to download and maintain secure personal backups of their purchased files.
16. 3D PRINTING RESULTS
Digital 3D models may require appropriate equipment, software, materials, slicing settings, supports, scaling, orientation, calibration, and user experience to print successfully.
Actual printing results may vary depending on:
- >Printer model.
- >Resin or filament.
- >Slicer software.
- >Supports.
- >Exposure or temperature settings.
- >Scale.
- >Printer calibration.
- >Orientation.
- >User preparation and experience.
Unless specifically stated otherwise in a product listing, purchasing a digital file does not guarantee a particular physical printing result.
17. ACCOUNT SUSPENSION OR TERMINATION
We may suspend, restrict, or terminate an account when we reasonably believe the account has been involved in:
- >Fraud.
- >Unauthorized file sharing.
- >Digital piracy.
- >License violations.
- >Payment abuse.
- >MAX Rewards manipulation.
- >Unauthorized access attempts.
- >Serious or repeated violations of these Terms.
Where appropriate and legally permitted, termination may result in loss of access to account-based services and unused promotional rewards.
Customers should maintain personal backup copies of legitimately purchased downloads.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, 3D Models 2 the Max will not be responsible for indirect, incidental, special, or consequential losses resulting from use or inability to use the Site or digital products.
Digital files are provided for use with compatible software and equipment, and customers are responsible for determining whether their equipment, software, skills, and intended use are appropriate.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
19. THIRD-PARTY SERVICES
Our Site may rely on third-party services for payment processing, website infrastructure, analytics, email delivery, file storage, authentication, or other functions.
Use of certain third-party services may also be subject to the applicable provider’s terms and privacy practices.
We are not responsible for third-party websites or services that we do not control.
20. CHANGES TO THESE TERMS
We may periodically update these Terms to reflect changes to our products, services, website functionality, MAX Rewards program, business practices, or applicable requirements.
Updated Terms will be posted on the Site with a revised effective date.
Material changes may also be communicated through additional reasonable means when appropriate.
21. GOVERNING LAW
These Terms and your use of the Site will be governed by applicable laws and regulations.
Any mandatory consumer rights or protections that apply to you based on your jurisdiction are not waived by these Terms.
